Prohibited Use Policy

1. Introduction


This Prohibited Use Policy ("Policy") describes and sets out prohibited activities and uses of our Platform, and any service offerings provided on those websites. This Policy aims to (i) protect the integrity of our Services, (ii) prevent and prohibit any illegal, unethical, or otherwise inappropriate practices on our platforms and websites, (iii) ensure compliance with applicable laws and regulations across Malaysia. Unless otherwise expressly provided in this Policy, all capitalised terms used herein shall have the same meaning as set forth in the User Agreement.


By accessing, using, or continuing to use our Services, you expressly acknowledge and agree to comply with this Policy in its entirety. You agree that any violation or breach of this Policy, including but not limited to engaging in illegal, unethical, or inappropriate activities, will result in immediate termination of your access to our Services and may subject you to legal action. You agree to indemnify, defend, and hold harmless the Company and its holding company (if any), subsidiaries (if any), affiliates, licensors and all its directors, members, officers, shareholders, partners, solicitors, employees, agents, service providers and all persons engaged by the Company in support of our Services from and against any and all claims, investigation, demand, liabilities, damages, losses, costs, and expenses, including legal fees and expenses, arising from or in connection with your breach of this Policy, your misuse of our Services, or any actions that have caused or may cause the Company to face adverse impacts, which includes but not limited to any legal, regulatory, financial or reputational risks. This indemnity covers any claims, proceedings, or regulatory actions brought against the Company as a result of your conduct, whether such conduct was deliberate or inadvertent.


If you do not agree to this Policy or cannot comply with its terms, please do not continue with the registration process and you must immediately cease using and accessing our Services. Your continued access to and use of our Services (including following any modifications to this Policy) constitutes your acceptance of this Policy and your acceptance of such updates or changes without exception or reservation, and you acknowledge that you are bound by its terms.


2. Prohibited Users


2.1 In addition to the eligibility criteria of a User as prescribed in the User Agreement, you undertake to abide by all applicable laws and regulations governing your use of our Services from time to time and you are ineligible, or you may be ineligible, to continue access to and use our Platform and our Services in the event of the occurrence of any of the following events:

(a) Users who have had their accounts suspended, investigated, or terminated by any platforms, websites, or service providers due to any violation, attempted violation, or suspected violation of laws, policies, terms, or misuse of services offered by any platform within jurisdictions where Our Services are available;

(b) Users whose activities, either directly or indirectly, violate any applicable laws, regulations or legal requirements in their jurisdiction, or any other applicable jurisdictions where our Platform operates. This includes but is not limited to activities involving fraudulent schemes, money laundering, financing of terrorism, or other prohibited or unlawful practices;

(c) you are listed on the list of specified individual or entity determined by the Ministry of Home Affairs under Section 66B(1) of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds from Illegal Activities 2001, and the sanctions database based on the United Nations Security Council Resolutions (UNSCR) list;

(d) Users who engage in, support, or are suspected of engaging in any activities that may harm, damage, disrupt, or impair the reputation, operations, security, or compliance of our Platform or any related services, or who may expose the Company to legal, regulatory, financial, or reputational risks, whether directly or indirectly, through misuse, misconduct, act, omission, or inaction, whether intentional or inadvertent in nature;

(e) you are past or present convict of crimes involving fraud and deceit, money laundering, or the liked criminal activities contrary to the laws or public policy of relevant governing jurisdiction; and/or

(f) you have any intent to transact with any of the foregoing prohibited persons.


3. Prohibited Activities


3.1 You shall not use, encourage, promote, facilitate or instruct any persons to use our Services or Platform for any illegal, harmful, fraudulent, infringing and offensive use, or to transmit, store, distribute, modify or otherwise make available any content or make any transaction that is illegal, harmful, fraudulent, infringing and offensive. Prohibited activities includes but not limited to:

(a) Fraudulent Activities: Engaging and involving in any form of deception, misrepresentation, or fraudulent activity intended to obtain unauthorised benefits.

(b) Unlawful Financial Activities: Engaging and involving in unauthorised or unregulated financial activities, such as unregistered securities trading, money laundering, terrorist financing, and other financial fraud schemes in any one or through a series of transactions.

(c) Illegal Activities and Transactions: Engaging and involving in any and all activities or transactions that violates laws and regulations of applicable jurisdictions in which the Company operates.

(d) Hate Speech and Harassment: Promoting or engaging in hate speech, harassment, or any form of discrimination against individuals or groups based on race, ethnicity, nationality, religion, gender, sexual orientation, or any other characteristic.

(e) Interception: Monitoring data or traffic on any of our Platform without permission.

(f) Malware Distribution: Uploading, distributing, or promoting malware, viruses, or any malicious software that could harm Users or the integrity of our Platform, and to intentionally and knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware of the Company.

(g) Unauthorised Access: Attempting to gain unauthorised access to network, account, database, system or information belonging to our Platform or any part thereof and the Users or other stakeholders.

(h) Intellectual Property Infringement: Distributing, sharing, or disseminating any copyrighted materials, intellectual property, or proprietary information owned by the Company or any third-party licensors (where applicable) without obtaining prior written consent. This includes, but is not limited to, reproducing, sharing, or altering materials in a way that infringes on trademarks, patents, or other intellectual property rights. Any form of unauthorised use, misappropriation, or trademark infringement is strictly prohibited and will be subject to enforcement action.

(i) Pyramid or Ponzi Schemes: Activities that rely primarily on the continuous recruitment of new participants to generate income for existing members, rather than through the sale or exchange of legitimate products or services.

(j) Gambling and Gaming: Any form of gambling, betting, and includes all online and offline gaming activities that are not compliant with governing domestic laws.

(k) Adult Content and Services: Activities that promote adult content, escort services, or related activities that may violate local regulations or community standards.

(l) Any Activity That May Cause Harm or Risk to the Company: Engaging in, facilitating, or promoting any activity or conduct, whether directly or indirectly, that may pose a risk to the Company, its reputation, operations, security, compliance, or the safety of its Users. This includes any action that could subject the Company to legal, regulatory, financial, or reputational harm, or that could disrupt or impair the integrity or availability of the Platform or its Services in any way.


4. Prohibited Use of Digital Assets and Regulatory Compliance


4.1 You agree not to use any digital assets issued by us or any of our Services for payment, remittance, or any other purpose that could be construed as a regulated authorized business under the Financial Services Act 2013 or any other applicable regulatory framework. This includes, but is not limited to, using our digital assets or our Services in any business activity that would require a license, registration, or regulatory approval from any governmental authority or regulatory body.


4.2 You acknowledge and agree that it is your sole responsibility to obtain independent legal advice to fully understand and comply with any and all applicable regulatory requirements before using any digital assets or our Services for any specific purpose. You represented to us that you have taken all necessary steps and prudence to make independent and informed decision before engaging our Services and the Company does not assume any responsibilities and liabilities in respect of any claims, losses, damages, liabilities, costs, or expenses (including but not limited to legal fees) arising out of or in connection with your actions or use of our Services.


4.3 You further agree that any breach of regulatory laws or any use of our digital assets or our Services in violation of licensing or regulatory requirements will be solely your responsibility, and you agree to assume full responsibility for any resulting fines, penalties, or legal consequences. Additionally, if the Company incurs any losses, damages, claims, or liabilities due to your non-compliant or unauthorized use of our digital assets or Services, you shall fully indemnify, defend, and hold the Company harmless against all such repercussions.


5. Compliance and Enforcement


The Company reserves the right, but we do not assume the obligation, to monitor all activities on our Platform and to investigate any violation of this Policy or misuse of our Services. We may investigate any suspicious interactions, activities or transactions and remove, disable access to, suspend or modify any contents or resources that violate this Policy in respect of your use of our Services.


In the event of any breach of this Policy, the Company reserves the sole and absolute discretion to take any action we deem right and reasonable to protect our interests, with or without notice to you, to mitigate any risk posed to our Platform or our Services due to your act, omission or negligence, including but not limited to (i) blocking or withholding any transaction that we deem to be associated with any prohibited activities or transactions, (ii) suspending, restricting or terminating your account and your access to and use of our Services, and/or (iii) such other corrective mechanism we deem necessary, depending on the severity of the violation or breach.


To comply with applicable disclosure and reporting obligations, we may provide necessary information, including your Personal Information, to relevant law enforcement agencies, regulatory authorities, or authorised third parties. This cooperation may include the provision of network, system, and account information to assist in the investigation and prosecution of any illegal activities or suspected violations of this Policy. We commit to taking all appropriate actions necessary to support these authorities in the lawful investigation and resolution of prohibited conduct.


If any of your action causes the Company to suffer any damages, losses, costs, or other liabilities, you agree that the Company has the full right to pursue all available legal remedies, including taking legal action to recover any such losses and damages.


6. Reporting Violations


Users are encouraged to notify and report any suspected violations of this Policy by contacting us at support@blox.my. All reports will be treated with strict confidentiality, and we are committed to taking prompt and appropriate action to address any legitimate concerns raised.


7. Policy Review


This Policy is current as of its Effective Date stated at the beginning of this Policy. We reserve our absolute right to change, modify, update, revise or amend this Policy or any part thereof, from time to time, including to incorporate necessary changes in law, technology or business practices. All updates will be posted on our website, and where applicable, we will notify Users of material changes that may impact on our handling and processing of Personal Information. We encourage you to periodically review this Policy for updates on our platform.


By continuing to use our Services after any changes, updates, or revisions to this Policy, you acknowledge and agree to be bound by the most current version of this Policy, including all amendments. If you do not agree with any part of this Policy or any future modifications, you must immediately cease all access to and use of our Services.
